Urged by virtually all advocates on the various stakeholder panels that the State should “slow down” on new proposals to expand efforts to shift people with disabilities and seniors eligible for both Medicare and Medi-Cal – referred to as “dual eligibles” - the Assembly Budget Subcommittee #1 on Health and Human Services and the Assembly Aging and Long Term Care Committee adjourned a nearly 6 hour informational hearing on the Governor’s controversial proposal to expand from 4 to 10 counties in 2013 and all counties by the end of 2015, an existing demonstration project proposal to shift those “dual eligible” from Medi-Cal “fee-for-service” to Medi-Cal managed care type plans.  No action was taken at the joint hearing.

The Senate Budget and Fiscal Review Committee will hold three informational hearings in February and March, including a February 23rd hearing focusing on the Governor's controversial proposals that include shifting persons with disabilities and seniors eligible for both Medicare and Medi-Cal into Medi-Cal managed care plans. That hearing will also hear the impact of the Governor's proposal to make In-Home Supportive Services, a Medi-Cal managed care benefit for those persons beginning next January, and also the impact on the Multi-Purpose Senior Services (MSSP) programs. Senate budget staff said there will be time for public comment.

The Department of Social Services released draft copies of notices to In-Home Supportive Services (IHSS) recipients and instructions to the counties regarding implementation of a 20% across the board reduction in service hours to all persons receiving In-Home Supportive Services, effective January 2012 - if a certain amount of state budget revenues will not come in as hoped for, triggering one or both of the state budget "trigger cuts" (the state budget "trigger cuts" are different from the federal budget "trigger cuts").

In addition to signing early this afternoon SB 87, the main State budget bill for 2011-2012 passed by legislative Democrats on a strict party-line majority vote, Governor Brown also signed into law 10 budget "trailer" bills, including three dealing with the so-called "trigger cuts" that are linked to about $2.5 billion in additional spending cuts to go into effect sometime after January 2012 if a certain level of revenues do not come into the State treasury as hoped for in the budget.

Governor Brown signed into law several budget related bills that authorize changes in State law to implement at least $8 billion in cuts in State general fund spending, including over $6 billion in cuts to health and human services impacting children and adults with disabilities, mental health needs, the blind, seniors, their families, community organizations and individual support workers and low income families across California.

The crucial revenue part of the Governor’s plan remains to be voted on – still lacking the needed 2 Republican votes in each house.  Until the Legislature is able to take action on that crucial part of the Governor’s budget, the on-going budget crisis will continue unresolved with the prospect of more enormous sweeping reductions.

The California Legislature took a major step in what it hopes will help to solve the State’s enormous budget crisis, by approving several of the budget related bills dealing with over $6 billion in cuts in State general fund spending to health and human services and reductions in general government that largely follow the Governor’s proposed reductions.

Both Senate President Pro Tem Darrell Steinberg and Assembly Speaker John Perez announced the State Senate and Assembly will convene Wednesday afternoon at 1:00 PM to vote on Governor Brown’s proposed budget for 2011-2012, as modified by the Budget Conference Committee.  The plan still lacks any support from legislative Republicans.

The  Budget Conference Committee voted to approve the Governor’s proposal to eliminate the Adult Day Health Care program.  The committee also took action to appropriate $85 million to transition people into a “new” version of the program.  The committee also approved major new reductions on CalWORKS, Medi-Cal, elimination of redevelopment agencies and an additional $50 million reduction in state general fund spending to developmental services.

The Budget Conference Committee met just under two hours Monday afternoon from about 3:15 PM to just before 5 PM focusing only on the Governor’s proposal to transfer, or “realign” certain state services to the counties, including certain public safety and mental health community-based services.  This report also includes a CDCAN compiled summary of the Governor's proposals and previous actions by the Assembly and state Senate on Adult Day Health Care, Multipurpose Senior Services Program and In-Home Supportive Services.

The Budget Conference Committee approved legislative language which directs the Department of Developmental Services to develop and submit for Legislative review, and possible later approval, of statewide standards that would impose limits on spending of regional center community-based services and supports.  The Budget Conference Committee took no action on IHSS, Adult Day Health Care or Multipurpose Senior Services Program.

The Budget Conference Committee convened for its first hearing this morning meeting for just about two and half hours to review but took no action on three of the nine major issues on Part 1 of its agenda: the transfer or “realignment” of certain public safety programs and responsibilities from the State to the counties; revenues and the Governor’s proposal to eliminate redevelopment agencies.  The second part of the committee's agenda was released and attached to this report.

The Senate Budget and Fiscal Review Committee staff analysis for February 17's hearing covering developmental services and other budget issues, concluded the size of the Governor’s proposed $750 million reduction in State general fund spending for regional centers and other developmental services is likely too high and “most likely, not achievable” at the level proposed due to a number of factors.

The legislature will soon be taking action on the Governor's proposed cuts to close a $12.5 billion budget deficit.  There are drastic proposed cuts to many programs including IHSS, CalWORKS, SSI/SSP, MSSP, regional centers, Medi-Cal, and many, many more.  Decisions are made by those who "show up" and, more importantly, made by others when people don't.
