After returning home in December, her condition was again critical due to serious complications that required last month a 10 day return to the hospital.

SACRAMENTO, CALIF (CDCAN) [Updated 11/23/09  05:22 PM  (Pacific Time)] - Governor Arnold Schwarzenegger announced today he is appointing State Sen. Abel Maldonado (Republican - Santa Maria), age 42,   as the next Lieutenant Governor, filling the vacancy caused by the resignation of John Garamendi who stepped down earlier this month after winning a special congressional election.  Maldonado would fill out the remainder of Garamendi's term, which expires in January 2011.

SACRAMENTO, CALIF (CDCAN) [Updated 11/23/09  07:20 AM  (Pacific Time)  -  The US Social Security Administration will investigate allegations by Rep. Robert Filner (Democrat - San Diego) made before the US House Way and Means Subcommittee on Social Security on November 19th that California is improperly denying social security and SSI (supplemental security income) program claims as a means to get around delays caused by mandatory furloughs of state workers in the Disability Determination Service division within the Department of Social Services, who play a critical role in determining eligibility for those two programs.  The investigation will also look at similar policies and problems in Hawaii which has instituted similar mandatory furloughs of its state employees.

SACRAMENTO, CALIF (CDCAN) [Updated 11/20/09  07:20 AM  (Pacific Time)  - Maggie "Dee" Dowling, a longtime respected disability and senior advocate remains in the intensive care unit (ICU) at John Muir Medical Center in Walnut Creek recovering after major surgery on Tuesday (November 17) to remove a life threatening cancerous tumor.  Dowling - known simply as "Maggie Dee" across the state, remains in very serious condition but her doctors report that they were able to remove all the cancer.  She faces a long recovery and is expected to remain in the east bay hospital for some period of time.

SACRAMENTO, CALIF (CDCAN) [Updated 11/02/09  10:33 PM  (Pacific Time)  -  The Assembly after a long marathon session in both houses that focused on the state's ongoing water crisis, passed a bill on a different crisis that impacts its most vulnerable population, approving amendments by Assemblymember Noreen Evans (Democrat - Santa Rosa) to SB 69 that would delay the November 1st implementation of several new requirements for In-Home Supportive Services (IHSS) workers.

The bill won support from both Assembly Democrats and Republicans - including support from Assembly Republican Leader Sam Blakeslee (Republican - San Luis Obispo).

The emergency "clean-up" legislation passed on a vote of  60 to 0.

CDCAN Report #294-2009: BREAKING NEWS - Governor's Department of Finance Director Genest Says He Will Be Stepping Down By End of Year

Governor's Finance Director Mike Genest To Step Down

SACRAMENTO, CALIF (CDCAN) [Updated 11/02/09  12:25 PM  (Pacific Time)  - Governor Arnold Schwarzenegger's Department of Finance director Mike Genest wrote in an email sent to department staff that he would be stepping down from his post, reportedly by the end of this year.  There is no official comment yet from the Governor's office regarding Genest's announcement or any possible replacement.  The Governor has just over a year left remaining in his term in office.

CDCAN Report #292-2009: Assembly Budget Committee Will Hold Follow-Up Hearing on IHSS Program Changes on November 5th

ASSEMBLY BUDGET COMMITTEE WILL HOLD FOLLOW-UP HEARING NOVEMBER 5TH ON IHSS PROGRAM CHANGES

SACRAMENTO, CALIF (CDCAN) [Updated 10/28/09  3:40 PM  (Pacific Time)  - After a two and a half hour sometimes contentious hearing, Assemblymember Noreen Evans (Democrat - Santa Rosa) announced she will convene a follow-up hearing on November 5th,  focusing on the implementation of major changes to the In-Home Supportive Services (IHSS) program due to go into effect November 1.  The location of the hearing and other details will be released later - though likely will be at the State Capitol in Room 4202.

The date of the follow-up hearing could change.  No action was taken at the informational hearing, though officials from the Schwarzenegger Administration said the State intends to go forward with new IHSS provider (worker) requirements November 1st .

The program changes to the IHSS program include new mandatory background checks and fingerprinting that was passed last July as part of the 2009-2010 revised State Budget.  Counties and advocates for people with disabilities, IHSS workers, seniors and other IHSS recipients say counties are not ready to implement those changes by November 1st and rhe result will mean "chaos and panic" and confusion for hundreds of thousands of IHSS recipients - who include children and adults with disabilities, mental health needs, the blind and low income seniors, and hundreds of thousands of IHSS workers (providers) across the State.

CDCAN Report #276-2009: Governor Signs 180 Bills So Far - Vetoes 183 as Deadline Nears

  • Approves AB 1269 Medi-Cal Working Disabled Program - But Vetoes SB 303
  • Nursing Facility Informed Consent Bill - Has Just Over 300 Bills To Go Before Midnight Deadline

SACRAMENTO, CALIF (CDCAN) [Updated 10/11/09  10:30 PM  (Pacific Time)] - With the deadline to sign or veto bills just one and half hours away, Governor Arnold Schwarzenegger has signed so far 180 bills and vetoed 183, for a total of 363 bills.  That leaves just over 300 or so bills left on his desk.

Among those bills the Governor signed was AB 1269 by Assemblymember Julia Brownley (Democrat - Santa Monica),  an important bill that extends eligibility for a little known Medi-Cal program called the "California 250% Working Disabled Program" that allows qualified individuals who are Medi-Cal recipients to have or obtain a job and still keep their Medi-Cal benefits. Persons in the program cannot make more than 250% over the federal poverty level and also must pay a monthly premium for their Medi-Cal benefits on a sliding scale based on their income.

The Governor signed AB 287 by Assemblymember Jim Beall (Democrat - San Jose) that would require the State Council on Developmental Disabilities to establish a permanent Employment First standing committee.  The Governor also signed several bills relating to foster and adoption assistance - programs that impact thousands of children with special needs.

The Governor approved AB 1533 that extends the sunset date on the law which subsidizes the cost of telephone services and equipment for customers who are deaf and persons with disabilities known as the "Deaf and Disabled Telecommunication  Program"  to January 1, 2014.

The Governor however vetoed several key bills impacting people with disabilities, including a bill by State Sen. Ellen Corbett (Democrat - San Leandro), SB 303,  relating to the right of a resident of a skilled nursing or intermediate care facility to receive information material to the decision to accept or refuse any treatment or procedure, including the administration of  psychotherapeutic drugs.
