Governor Wins Clear Legal Victory – State Appeals Court Says Line Item Vetoes “Constitutional”

Lawsuit Is One of Three Filed Seeking To Overturn Governor’s Line Item Vetoes Made to 2009-2010 Revised State Budget Last July

SACRAMENTO, CALIF (CDCAN) [Updated 03/02/2010  07:40 PM  (Pacific Time)] - The Schwarzenegger Administration won a clear legal victory today with the State Court of Appeals in San Francisco ruling 3 to 0 that his line item vetoes made to the revised 2009-2010 State Budget last July were constitutional.  The case, St. John’s Well Child and Family Center et al v. Schwarzenegger et al, is one of three different lawsuits seeking to overturn some or all of the Governor’s line item vetoes made last July.

SACRAMENTO, CALIF (CDCAN) [Updated 02/011/2010 07:40 AM (Pacific Time)] - The California Department of Social Services, the state agency that oversees statewide the In-Home Supportive Services program that serves over 460,000 children and adults with disabilities, mental health needs, the blind and seniors, is hosting today (February 11) from 1:30 to 3:30 PM, a public stakeholder meeting on the controversial issue regarding the development and implementation of the IHSS Fingerprint Imaging (with certain specific exceptions allowed) as required by ABx4 19, (Chapter 17, Statutes of 2009), the budget related bill that added several new IHSS program requirements which included fingerprint imaging of IHSS recipients. These requirements are in addition to new requirements – including fingerprinting – for IHSS workers (providers).

After returning home in December, her condition was again critical due to serious complications that required last month a 10 day return to the hospital.

Current Status This bill has passed out of the Senate by a vote of (31 Ayes, 1 No) and it has moved to the Assembly for concurrence. Digest This bill enacts the Crime Victims with Disabilities Act of 2010 which (1) requires domestic violence death review teams to add information about whether or not a victim had a disability, (2) allows counties to add dependent adult cases to any elder death review teams and protocols they may already have, (3) requires the Commission on Peace Officer Standards and Training (POST) and the Department of Justice to create a two-hour "Crime Victims with Disabilities" telecourse for law enforcement officers and permits that every law enforcement agency that complies with POST training, provide this telecourse training for its officers, and (4) creates new reporting requirements for the Department of Developmental Services.

Extends to January 1, 2015, the sunset date of an advisory council which provides consultation to the Department of Public Health (DPH) Domestic Violence Program (DVP), and requires DPH and the California Emergency Management Agency (Cal EMA) to consider consolidation of their respective domestic violence (DV) programs.

This bill establishes a pilot project that would create additional requirements in the court approval process for requests to administer psychotropic medications to children in foster care. This bill requires the Judicial Council to adopt specified rules and forms to implement the project by July 1, 2010. The pilot project will be operative until January 1, 2013, in three counties, selected by the Department of Social Services (DSS) in consultation with the California Welfare Directors Association, California Mental Health Director Association and the Judicial Council. This bill requires DSS, after consultation with the Department of Mental Health, to report to the Legislature before July 1, 2013, regarding the findings of the pilot project, as specified.

Enacts the Nursing Facility Resident Informed Consent Protection Act of 2009, which establishes the right of a resident of a skilled nursing or intermediate care facility (nursing facility) to receive information material to the decision to accept or refuse any treatment or procedure, including the administration of psychotherapeutic drugs, and codifies existing regulations requiring attending physicians to obtain informed consent after providing specified material information.
