SACRAMENTO, CALIF (CDCAN) [Updated 07/07/2010 09:50 AM (Pacific Time)] – With California now seven days without a new state budget and no overall agreement near on how to resolve the enormous $20 billion budget shortfall, the Budget Conference Committee will resume its hearings with a meeting today (July 7th, Wednesday) at 3:00 PM at the State Capitol in Room 4203. Today’s hearing is expected to continue the committee’s work on trying to take action on several of the remaining “open” items, though it is not certain yet what specific items they will actually take up this afternoon.
Bills Not Passed Out of Both Houses Today Cannot Have Further Action Again Until January 2010
SACRAMENTO, CALIF (CDCAN) [Updated 09/011/09 05:00 AM (Pacific Time)] - The California Legislature will reconvene this morning for what will be its final full day of the 2009 regular legislative session. Both houses are scheduled to adjourn sometime late today and will not reconvene the regular session of the Legislature until January (though the Legislature is expected to return sometime in the fall for what will likely be one or two or more special sessions to deal with various budget and other issues).
Legislation That Would Partially Reverse 2009-2010 State Budget Act Rate Freeze on Freestanding Nursing Homes Now Likely A 2-Year Bill
SACRAMENTO, CALIF (CDCAN) [Updated 09/09/09 5:40 PM (Pacific Time) - Final action on AB 411 by Assemblymember Hector De La Torre (Democrat - South Gate, 50th District) will likely not happen until next year, making the legislation which would partially reverse the rate freeze on freestanding nursing facilities originally imposed as part of the revised 2009-2010 State Budget enacted last July, a "two year bill". The bill also would expand the number of facilities required to pay a special fee, called a Medi-Cal "Quality Assurance Fee" that was imposed by a 2004 bill, AB 1629. The news regarding the delay has not yet been officially reported.
The delay in further action on AB 411 would be at least a temporary victory for those who opposed the measure, including disability advocacy groups, though it is not clear yet the specific reasons why further action on the measure was put off until next year.
Controversy erupted late last week after AB 411 was completely changed with amendments on September 2nd, - a legislative maneuver known as "gut and amend" - a sometimes used by legislators during the final weeks and days of the legislative session to move controversial bills. However, for a bill to actually move forward at this late date requires special permission - rule waivers - from the leadership in both houses, which is very difficult to get.

Many Disability Advocacy Groups Say De La Torre Bill Is A Unfair "Gut and Amend" Measure - Would Reverse Freestanding Nursing Facility Rate Freeze in 2009-2010 State Budget Trailer Bill Passed In July
SACRAMENTO, CALIF (CDCAN) [Updated 09/07/09 4:00 PM (Pacific Time) - Major controversy has erupted over a bill, AB 411 by Assemblymember Hector De La Torre (Democrat - South Gate, 50th Assembly District), that was completely changed with amendments on September 2nd, a legislative maneuver known as "gut and amend," that would reverse the rate freeze imposed on freestanding nursing facilities originally imposed as part of the revised 2009-2010 State Budget enacted in late July.
That rate freeze was in one of several budget related bills (called "trailer bills"), ABx4 5 ("x4" stands for 4th special or extraordinary session). The bill, as amended last week, could pit many disability, senior advocacy groups and unions representing nursing home workers against each other who normally would be allies on other issues such as In-Home Supportive Services (IHSS). AB 411, as amended, is set for hearing Tuesday, September 8th, in the Senate Health Committee, at the State Capitol in Room 3191. The hearing starts when called or announced by the chair.
The committee chair, State Sen. Elaine Alquist (Democrat - Santa Clara, 13th District), has not yet announced when the hearing will start. The State Senate is not scheduled to convene after the four day holiday weekend until 11:00 AM on Tuesday - so the hearing is likely to occur sometime after that time.
