FINAL HOURS OF 2009 LEGISLATIVE SESSION

Bills Not Passed Out of Both Houses Today Cannot Have Further Action Again Until January 2010

SACRAMENTO, CALIF  (CDCAN) [Updated 09/011/09  05:00 AM  (Pacific Time)] -  The California Legislature will reconvene this morning for what will be its final full day of the 2009 regular legislative session.  Both houses are scheduled to adjourn sometime late today and will not reconvene the regular session of the Legislature until January (though the Legislature is expected to return sometime in the fall for what will likely be one or two or more special sessions to deal with various budget and other issues).

The Assembly is scheduled to convene at 09:30 AM and the State Senate will come into session at 10:00 AM.

Below is a summary of several bills that had action yesterday (September 10) that have some impact on people with disabilities, mental health needs, seniors, low income families, providers, persons who are deaf and others.

AB 411 was amended yesterday which removed the entire contents of the bill dealing with nursing facilities and the Medi-Cal Quality Assurance Fee (and also replacing the authors) and replaced it provisions dealing with health facility seismic safety issues.

AB 1260, a bill dealing with developmental services, passed out of Senate Human Services Committee yesterday, and was referred to Senate Appropriations Committee. However the bill was subsequently withdrawn from that committee and re-referred back to Senate Rules Committee.

CDCAN will be providing up to the minute reporting of the Legislature's final day - plus a full report over the weekend of the actions on all bills.

The Governor will have until October 11th to sign or veto bills sent to him by the Legislature.

DEVELOPMENTAL SERVICES

AB 1260 - DEVELOPMENTAL SERVICES: REGIONAL CENTERS

AUTHOR:  Assemblymember Jared Huffman (Democrat - San Rafael, 6th Assembly District)

CDCAN SUMMARY

The bill, as amended most recently on September 4th would do the following:

  • Respite: under current state law (as enacted last July as part of the revised 2009-2010 State Budget), a regional center is prohibited from funding more than 21 days of out-of-home respite services in a state budget year (July 1 through June 30) and more than 90 hours of in-home respite services in a quarter. AB 1260 would change that provision and instead prohibit the regional centers from funding more than 98% of the annualized volume of in-home and out-of-home respite services used by a person with developmental disabilities (consumer) who received those services in the 2008-2009 state budget year (the previous state budget year).
  • Senior Program Requirement: under current state law (as enacted last July as part of the revised 2009-2010 State Budget) requires vendors of prescribed services to offer an alternative senior program component. AB 1260 would change that provision and instead permit this component to be offered and would require the programs to be offered within the provider's existing capacity and would allow vendors to formulate agreements to meet the program needs. The bill would also require the regional centers to take appropriate steps to make sure that sufficient program capacity exists to meet the individual needs of persons with developmental disabilities (consumers) wishing to enroll in alternative senior programs that are consistent with the individual's Individual Program Plan (IPP).
  • Other provisions of the bill that were previously a part of the bill in the August 27th and September 2nd versions of the bill were taken out of the bill with the September 4th amendments.

LATEST ACTION 09/10/09:  Passed Senate Human Services Committee and re-referred to Senate Appropriations Committee by vote of 4 to 0.  Referred to Senate Appropriations Committee.  Withdrawn from Senate Appropriations Committee.  Re-referred to Senate Rules Committee.

NEXT STEPS:  Bill is held currently in Senate Rules Committee and will need additional rule waivers to be referred and heard in Senate Appropriations Committee, and if heard and approved there, would need rule waivers to be referred to the Senate floor for a final vote (2/3rds vote needed or 27 votes of the 40 member State Senate).  If that happens, the bill would need to repeat the entire process, including rule waivers, in the Assembly, all before the 2009 regular Legislative session ends sometime late on Friday, September 11th.

CDCAN SUMMARY

This bill was amended on 09/10/09 with all provisions dealing with nursing facilities and Medi-Cal Quality Assurance Fee taken out and replaced by provisions dealing with health facilities and seismic safety issues.

NEXT STEPS:  Bill would need rule waivers to be heard in Senate Appropriations Committee, and if passed there, additional waivers to be referred to the State Senate floor for final vote - and repeating that process, with the need for additional waivers, in the Assembly before the 2009 Legislative session adjourns for the rest of the year on Friday, September 11th.

CDCAN NOTE:  The previous contents of the bill dealing with skilled nursing facilities and the Medi-Cal Quality Assurance Fee that was amended into the bill on 09/02/09, were completely deleted with new amendments on 09/10/09 replacing the entire bill with a new subject dealing with seismic safety issues relating to health facilities.   Authors of the bill were also changed.

AB 762 - RESIDENTIAL FACILITIES: BEDRIDDEN PERSONS

  • Clarifies the appropriate fire safety standards for individuals in residential care facilities.
  • Specifies that residents who are unable to independently transfer to and from bed, but who do not need assistance turning and repositioning in bed shall be considered nonambulatory for determining the appropriate fire safety requirements.

SB 303 - NURSING FACILITIES RESIDENTS: INFORMED CONSENT

Enacts the "Nursing Facility Resident Informed Consent Protection Act of 2009", which would establish the right of a resident of a skilled nursing or intermediate care facility (nursing facility) to receive information material to the decision to accept or refuse any treatment or procedure, including the administration of psychotherapeutic drugs, and codifies existing regulations requiring attending physicians to obtain informed consent after providing specified material information.

SB 337  - PATIENT INFORMATION - HOME HEALTH AGENCIES, HEALTH FACILITIES, CLINICS, HOSPICE

AUTHOR: State Sen. Elaine Alquist (Democrat - Santa Clara, 13th Senate District)

CDCAN SUMMARY

  • Would require a clinic, health facility, home health agency, or hospice to report any unauthorized access to, or use or disclosure of, a patient's medical information to the Department of Public Health and to the affected patient or patient's representative, no later than five business days, instead of five days, after the unlawful or unauthorized access, use, or disclosure has been detected by the entity.
  • Would make other clarifying changes to requirements governing reporting of unauthorized access to, or use or disclosure of, patients' medical information, and provides limited exemptions for law enforcement investigations.

AB 754 - MEDI-CAL: MENTAL HEALTH PLANS

  • Would require the Department of Mental Health to allocate and distribute the full contracted amount of General Fund payment for the managed mental health care program, exclusive of the Early and Periodic Screening Diagnosis, and Treatment Program specialty mental health services provided under the Medi-Cal specialty mental health services waiver, at the beginning of the contract period.
  • The allocated funds shall be considered to be funds of the plan that may be held by the Department of Mental Health, which shall develop a methodology to ensure that these funds are held as the property of the plan and shall not be reallocated by the department or any other entity of state government for other purposes.
  • This bill would become operative on July 1, 2011.

AB 839 - MEDI-CAL SERVICE PROVIDERS: REMEDIES

  • Would make changes related to provider appeals in the Medi-Cal program.
  • Would require that the judicial remedy for Medi-Cal providers seeking to appeal the denial of a grievance or complaint related to Medi-Cal reimbursement is to file a petition for a writ of mandate in State superior court.
  • Would require that the prohibition on enrollment as a Medi-Cal provider to begin on the date of the providers' denial or termination of enrollment, rather than the date when the provider appeals.

  • Would provide that if the California Architects Board determines, based upon empirical evidence, that the public health, safety and welfare would be served by requiring all licensed architects to complete continuing education, then the California Architects Board may require a licensee to certify completion of continuing education requirements as a condition of license renewal.
  • Would require the licensee to certify on a form prescribed by the California Architects Board that he or she has completed continuing education in or relevant to, the practice of architecture in subjects relating to health, safety, and welfare during the preceding two years, as determined by the California Architects Board.
  • The bill states that coursework in disability access requirements shall be applied to any continuing education hours prescribed by the California Architects Board.
  • Makes other changes and requirements regarding continuing education.

Would establish a fully self-supported pilot project by the Judicial Council  for the appointment of legal representation for unrepresented low-income parties in civil matters involving critical issues, such as domestic violence, child custody and elder abuse so that judicial decisions are made on the basis of the necessary information and the parties have an adequate understanding of the orders to which they are subject.
